High Level Online Side Event – Championing the elimination of trafficking in human beings and the exploitation of prostitution

Heute fand eine wichtige Veranstaltung mit vielen bedeutenden Personen im Kampf gegen Menschenhandel und sexuelle Ausbeutung statt. Ich war auch dabei und konnte ein paar mir wichtige Dinge einbringen. Unten im Video könnt ihr alles anschauen.

On the occasion of the 47th Regular Session of the Human Rights Council and the 79th Session of the Committee on the Elimination of Discrimination against Women in Geneva, CAP International gathers States, International organisations and Survivors leaders to highlight international human rights law and good practices to eliminate trafficking in human beings and the exploitation of prostitution. Trafficking in human beings and the exploitation of prostitution constitute a serious violation of human rights. Most identified victims are women and girls, their sexual exploitation being the purpose of trafficking is linked to organised crime in most cases. The total number of victims has grown considerably following the unprecedented increase in migration and forced displacement, due to armed conflicts, persecution, human rights violations, and the outbreak of COVID-19. 6 months after the adoption of CEDAW General recommendation No. 38 on trafficking in women and girls in the context of global migration and 2 years after France and Sweden have developed a common strategy for combating human trafficking for sexual exploitation in Europe and globally, this event aims to create a platform to share lessons learned on efforts to eliminate sexual exploitation and to improve cooperation as well as to support advocacy, initiatives and the mobilisation of additional resources.

Discouraging the demand that fosters trafficking for the purpose of sexual exploitation

Ein gibt ein sehr wichtiges neues Dokument der OSCE, das den Blick auf die Nachfrageseite richtet und sich mit verschiedenen gesetzlichen Ansätzen in Bezug auf diese Nachfrage auseinandersetzt. Hier vor allem:

1. Criminalizing the knowing use of services of a trafficking victim
2. Criminalizing the use of all trafficking victims (strict liability)
3. Criminalizing all sex buying

Bericht der OSZE – Komplexe Täterbindungen im Bereich Menschenhandel verstehen

Es gibt einen sehr guten, kürzlich erschienenen, Report von der OSZE (Organisation für Sicherheit und Zusammenarbeit in Europa). Er handelt u.a. ebenfalls, passend zu meinem letzten Beitrag über Trauma Bonding, über komplexe Täterbindungen im Bereich Menschenhandel, die zu erkennen und zu durchdringen wichtig sind. Auf der einen Seite, um den Betroffenen da raus zu helfen, und auf der anderen Seite für eine effektive und erfolgreiche Strafverfolgung und Verurteilung.

Folgend Auszüge von diesem enorm wichtigen Bericht:

„Gender and the victim/trafficker relationship

In THB cases, the relationship between the victim and the trafficker may be complex. It may involve trauma bonding, familial ties and romantic relationships, and also violence, fear and manipulation. Exploring the trafficking history and, in particular, the gender dynamics of the victim/trafficker relationship is essential for law enforcement to understand the strategies used by the trafficker to exert power and control over the victim, as well as to identify any impediments to the victim cooperating with law enforcement. This can help answer a common question that comes to mind when the criminal justice system faces a victim: “Why didn’t you just run away?” The UN Special Rapporteur on trafficking in persons has underlined that the power imbalance used by traffickers to impose exploitative conditions “has a strong gender component, as women and girls are subject to intersecting discrimination as a consequence of patriarchal social norms.” Understanding the complexity and nature of victim–perpetrator relationships will also make it easier for law enforcement to comprehend a victim’s behaviour, which is sometimes aimed at protecting their trafficker at their own expense.
